Novack and Macey’s client, Arjo-Centre Distributing (ACD) and its owner Karman Cusack was the 11 Western states exclusive distributor for Arjo Inc., a publicly traded, multi-billion dollar Swedish company that manufactures specialized medical equipment for hospitals, nursing homes, and care facilities worldwide.  Our client terminated its distributorship agreement and entered into a new relationship with a major competitor of Arjo called Handicare USA.  Arjo sued and sought a preliminary injunction to prevent our client and its owner from using Arjo’s “trade secrets.” 

The Court issued an opinion denying the motion for preliminary injunction because "Arjo failed to make a sufficient showing of harm" and it’s ITSA claim is "insufficiently likely to succeed."
