Eric Macey and Elizabeth Wolicki recently beat back a motion for a temporary restraining order in federal court on behalf of defendants Arjo-Century Distributing, Inc. and its owner, Karman Cusack. 

The plaintiff, Arjo, Inc., is a global supplier of medical devices, services, and solutions for people with reduced mobility and age-related health challenges.  The motion for TRO claimed that Arjo-Century Distributing, Inc. (Arjo, Inc.’s former distributor in an 11-state territory) and Cusack used Arjo, Inc. ’s confidential information and trade secrets to injure Arjo’s customer relations and overall business.  After briefing and oral argument, the motion was denied by U.S. District Judge Matthew F. Kennelly.
