Motion to Dismiss Complaint Against Novack and Macey’s Clients Granted

Novack and Macey attorneys Stephen Novack, Tim Miller and Joe Nacca have obtained the partial dismissal of a complaint filed against the firm’s clients, the directors of The ZAH Group, Inc and Klein Tools, Inc. On June 4, 2008, Judge Brigid Mary McGrath, of the Circuit Court of Cook County, granted in part the motion that Novack and Macey filed on behalf of its clients requesting that the complaint filed against them by the former CEO of Klein Tools be dismissed. The Court agreed with Novack and Macey’s argument that a complaint related to the firing of an officer-director-shareholder of a corporation depended primarily on the terms of the fired officer’s employment contract and did not state a claim for breach of fiduciary duty.
